1. Acceptance of Terms
By accessing and using Dale Ride ("the Platform"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these terms, please do not use our services.
2. Service Description
Dale Ride is a ridesharing platform that connects drivers and passengers in Costa Rica. We facilitate connections but are not a transportation provider. All rides are arranged directly between users.
2.1 Platform Role
- We provide a technology platform to connect users
- We are not a party to any agreement between drivers and passengers
- We do not employ drivers or control their vehicles
- Payment processing is facilitated through our platform
3. User Eligibility
To use Dale Ride, you must:
- Be at least 18 years old
- Have the legal capacity to enter into binding contracts
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Not have been previously banned from the platform
4. Driver Requirements
If you wish to offer rides, you must additionally:
- Hold a valid Costa Rican driver's license
- Own or have authorized use of a roadworthy vehicle
- Maintain valid vehicle insurance (SOAP and Marchamo)
- Have no serious traffic violations in the past 3 years
- Pass any background checks we may require
- Comply with all Costa Rican traffic laws and regulations
5. User Conduct
Users agree to:
- Be Respectful: Treat all users with courtesy and respect
- Be Honest: Provide accurate information about rides and profiles
- Be Safe: Follow safety guidelines and local laws
- Be Responsible: Honor your commitments and bookings
5.1 Prohibited Activities
Users must NOT:
- Use the platform for illegal activities
- Harass, threaten, or intimidate other users
- Post false or misleading information
- Impersonate another person or entity
- Attempt to circumvent payment systems
- Use the platform for commercial taxi services without proper licensing
6. Payments and Fees
6.1 Payment Methods
We accept the following payment methods:
- SINPE Móvil: Free instant transfers (Costa Rica only)
- Credit/Debit Cards: Visa, Mastercard, American Express
- Cash: Direct payment to driver (driver's discretion)
6.2 Service Fees
Dale Ride charges a service fee on each completed ride:
- The platform retains a percentage of each transaction
- Fees are clearly disclosed before booking confirmation
- Service fees are non-refundable except as required by law
6.3 Currency
Prices are displayed in Costa Rican Colones (₡) with USD conversions for reference. Exchange rates may vary.
7. Cancellations and Refunds
7.1 Passenger Cancellations
- More than 24 hours before departure: Full refund
- 6-24 hours before departure: 50% refund
- Less than 6 hours before departure: No refund
- No-show: No refund
7.2 Driver Cancellations
- Drivers who cancel confirmed rides may face account restrictions
- Passengers receive automatic full refunds for driver cancellations
- Emergency cancellations are reviewed case-by-case
8. Liability and Insurance
IMPORTANT: Dale Ride is a platform service only. We are not liable for:
- Accidents, injuries, or damages during rides
- Lost or stolen property
- Driver or passenger conduct
- Vehicle mechanical failures
- Delays or cancellations
8.1 Driver Insurance
Drivers are solely responsible for maintaining adequate insurance coverage. Passengers should verify driver insurance before accepting rides.
8.2 Limitation of Liability
To the maximum extent permitted by Costa Rican law, Dale Ride' total liability shall not exceed the amount of fees paid by you in the 12 months preceding the claim.
9. Privacy and Data
Your use of the platform is also governed by our Privacy Policy, which is incorporated into these terms by reference.
10. Account Termination
We reserve the right to suspend or terminate accounts that:
- Violate these Terms & Conditions
- Engage in fraudulent activity
- Receive multiple user complaints
- Pose safety risks to other users
Users may also delete their accounts at any time through their profile settings.
11. Governing Law
These Terms & Conditions are governed by the laws of Costa Rica. Any disputes shall be resolved in the courts of San José, Costa Rica.
12. Changes to Terms
We may update these terms from time to time. Continued use of the platform after changes constitutes acceptance of the new terms. We will notify users of significant changes via email or platform notifications.
